Terms of Service and Sale

These terms govern access to and use of Carouscale (the “Service”), published by the entity identified in the legal notice (the “Publisher”). By creating an account or using the Service, you accept these terms.

1. Purpose of the service

Carouscale is a tool for finding and recreating TikTok Shop carousels: browsing public carousels that perform, analyzing them, and generating visuals with artificial intelligence. Carouscale is not affiliated with, endorsed by or sponsored by TikTok or ByteDance.

2. User account

Creating an account requires a valid email address. You are responsible for keeping your credentials confidential and for any activity carried out from your account. The Service is restricted to people aged 18 or over, or using the Service in a professional capacity.

3. Subscriptions, credits & payment

The Service offers subscriptions with no long-term commitment and credit packs. Credits are spent to generate slides, at a rate that depends on the feature and the resolution (1 to 6 credits per slide), shown in the app before each generation. Payments are processed by our provider Stripe; we never store card details. Subscriptions renew automatically at each period and can be canceled at any time from your account; cancellation takes effect at the end of the current period, with no pro-rated refund. Prices are shown in euros, applicable taxes added where relevant.

4. Right of withdrawal

Under consumer law, you in principle have a 14-day withdrawal period for contracts concluded at a distance. However, the Service provides digital content and services performed immediately: by starting a generation or spending credits before the end of that period, you expressly request immediate performance and acknowledge waiving your right of withdrawal for the part already performed. Unused credits from a one-time purchase remain refundable on request within the 14-day period.

5. Intellectual property

The visuals and texts you generate with Carouscale belong to you and you may use them, including for commercial purposes. You are solely responsible for how you use them and for respecting third-party rights (trademarks, image rights, copyright). Third-party content viewed on the Trends page remains the property of its authors and is displayed for analysis and inspiration purposes. The Carouscale brand, interface and code remain the property of the Publisher.

6. Acceptable use

You agree not to use the Service to generate content that is unlawful, misleading, defamatory, infringes third-party rights, or breaches the rules of the platforms where it is published (including TikTok). Unsubstantiated health claims and “before / after” staging prohibited by TikTok are in particular forbidden. Any abusive use may lead to account suspension without refund.

7. Availability & liability

The Service is provided “as is”. We do our best to keep it available but do not guarantee uninterrupted operation or the commercial results obtained with generated content. To the extent permitted by law, the Publisher's liability is capped at the amount paid over the last 12 months.

9. Affiliate program

Every account holder gets an affiliate link, with no application and no audience threshold. The code from that link is stored in the browser of the person who clicks it: it has no expiry date, but it stays tied to that browser (clearing the site's data or switching device loses the attribution) and, if several links are clicked, the last one before sign-up is the one that counts. Attribution becomes final at sign-up: a person is attached to a single referrer, and nobody can refer themselves.

The commission is 25% of the amount actually paid by your referral for their subscription, during the 3 months following their first payment. This is real money, not credits. No commission is due on: credit packs (the program rewards bringing in a subscriber, not their consumption), invoices discounted by 29.5% or more, trial periods and any payment of zero; a commission may also be capped where paying it in full would exceed the margin on the invoice concerned. If a referral's payment is refunded or disputed, the corresponding commission is cancelled. Unless specific terms have been agreed with the Publisher, your link does not change the price your referral pays; they receive 30 credits for the referral, at the latest on their first payment.

Commissions are denominated in euros and build up on your affiliate balance. From €15 of available balance you can request a payout from your Referrals page; the transfer is made through Stripe and requires a completed Stripe Connect account enabled to receive funds. You remain responsible for your own reporting and tax obligations on that income.

Self-referral, including through a second account, fake accounts, spam and any misleading presentation of the Service (promised earnings, claimed affiliation with TikTok) are prohibited. In case of breach, the commissions concerned may be cancelled and access to the program withdrawn. The Publisher may change the rate, the duration or the payout threshold for the future, without calling into question commissions already earned; specific terms (a longer window, a dedicated perk for your referrals) may be agreed with certain partners, with no effect on other accounts.

10. Changes to these terms

The Publisher may amend these terms. Users are informed of substantial changes; continued use constitutes acceptance of the updated version.

11. Governing law & disputes

These terms are governed by the law applicable at the Publisher's registered office. In the event of a dispute, an amicable solution will be sought first; consumers may use a consumer mediation service free of charge. Failing agreement, the competent courts will have jurisdiction.
