Terms of Service and Sale

These terms govern access to and use of Carouscale (the “Service”), published by Carouscale LLC, a company registered in the State of Montana (United States), whose details appear in the legal notice (the “Publisher”). By creating an account or using the Service, you accept these terms.

1. Purpose of the service

Carouscale is a tool for finding and recreating TikTok Shop carousels: browsing public carousels that perform, analyzing them, and generating visuals with artificial intelligence. Carouscale is not affiliated with, endorsed by or sponsored by TikTok or ByteDance.

2. User account

Creating an account requires a valid email address. You are responsible for keeping your credentials confidential and for any activity carried out from your account. The Service is restricted to people aged 18 or over, or using the Service in a professional capacity.

3. Subscriptions, credits & payment

The Service offers monthly, quarterly and yearly subscriptions, as well as credit packs. Credits are spent to generate slides, at 3 credits per slide (1K render, in Create and Replicate alike), shown in the app before each generation. Questions asked to CarouPilot do not use credits. Payments are processed by our provider Stripe; we never store card details. Subscriptions taken out before November 3, 2026 with the previous publisher of the Service are taken over by Carouscale LLC at their next renewal, with no change to the plan, price or credits. To do so, your customer record and the payment method saved with Stripe are shared between the previous publisher's Stripe account and that of Carouscale LLC, and your bank statement may show a new descriptor. Each subscription is paid upfront for the length you choose (1 month, 3 months or 1 year): you commit to that period, and to that period only. It renews automatically for the same length at each due date and can be canceled at any time from your account; cancellation stops the next renewal and takes effect at the end of the current period, already paid for, with no pro-rated refund. For each month of the paid period, the subscription entitles you to the credits of its plan. Credits never expire: unused credits stay on your account from one month to the next. Without an active subscription they are kept but locked, and they unlock as soon as you resume a subscription, whose allowance is added to them. If a renewal payment fails, access to paid features (generation, packs, automations) is suspended 24 hours after the failure and until the invoice is paid; your credits remain yours in the meantime. A move to a higher plan takes effect immediately and its prorated amount is charged right away; a move to a lower plan or a shorter billing period takes effect at the end of the current period. Prices are shown in euros, in US dollars for the United States market and in pounds sterling for the United Kingdom market, applicable taxes added where relevant.

4. Refunds and right of withdrawal

Credits are digital content supplied immediately: the credits of a pack, and those of the first month of a subscription, are added to your account as soon as your payment is confirmed. At checkout, you request this immediate supply and acknowledge that you thereby lose your right of withdrawal, as consumer law provides for digital content not supplied on a tangible medium (Article 16(m) of Directive 2011/83/EU). As a commercial gesture, you can still ask for a refund of the first payment of a subscription within 14 days of it, as long as you have generated fewer than 3 carousels since that payment (one carousel = one generation started in Create or Replicate, whatever its number of slides). From the 3rd carousel generated after the payment, no refund is possible, in whole or in part. Subscription renewals, the remaining months of a canceled subscription and credit packs are never refunded. A restriction or suspension of your TikTok account, or of an account on another third-party service, gives no right to a refund. This does not affect your rights if the Service does not work as intended (legal guarantee of conformity).

Auto top-up (Max plan): if you turn it on, you authorize Carouscale to charge the card on your subscription, without asking you again, the displayed price of the pack you chose, each time your balance reaches or drops below the threshold you set or one of your automations runs short of credits. Each top-up is billed at the public price of the pack, in the currency of your subscription, and its credits are only added once the payment is accepted. You can set a maximum number of top-ups per month and turn top-ups off at any time from your account. If your card is declined or your bank asks for a confirmation, top-ups turn off and you are told by email. A top-up is a credit pack: it follows the refund rules for packs above.

5. Intellectual property

The visuals and texts you generate with Carouscale belong to you and you may use them, including for commercial purposes. You are solely responsible for how you use them and for respecting third-party rights (trademarks, image rights, copyright). Third-party content viewed in the Carousel Catalog remains the property of its authors and is displayed for analysis and inspiration purposes. The Carouscale brand, interface and code remain the property of the Publisher.

6. Acceptable use

You agree not to use the Service to generate content that is unlawful, misleading, defamatory, infringes third-party rights, or breaches the rules of the platforms where it is published (including TikTok). Unsubstantiated health claims and “before / after” staging prohibited by TikTok are in particular forbidden. Any abusive use may lead to account suspension without refund.

7. Availability & liability

The Service is provided “as is”. We do our best to keep it available but do not guarantee uninterrupted operation or the commercial results obtained with generated content. To the extent permitted by law, the Publisher's liability is capped at the amount paid over the last 12 months.

9. Affiliate program

Every account holder gets an affiliate link, with no application and no audience threshold. The code from that link is stored in the browser of the person who clicks it: it has no expiry date, but it stays tied to that browser (clearing the site's data or switching device loses the attribution) and, if several links are clicked, the last one before sign-up is the one that counts. Attribution only happens at sign-up, when the account is created with the referrer's link, and then becomes final: a person is attached to a single referrer, and nobody can refer themselves. An existing account, or one that has already made a payment, can never be attached afterwards.

For a referral attached from October 29, 2026, 12 a.m. (midnight, Paris time), the commission is 15% of each of their subscription payments (amount actually paid), from the first one and for life, as long as they remain subscribed, whatever the plan and subscription length chosen (1 month, 3 months or 1 year). This is real money, not credits. The commission stops for good when your referral cancels their subscription or when it ends: if they subscribe again later, no further commission is due on their payments. If you have not logged in to your account for more than 12 months, no commission is due on payments received until you log in again; the commission then resumes on the following payments, with no retroactive effect. No commission is due on: credit packs (the program rewards bringing in a subscriber, not their consumption), invoices discounted by 29.5% or more, trial periods and any payment of zero; a commission may also be capped where paying it in full would exceed the margin on the invoice concerned. If a referral's payment is refunded or disputed, the corresponding commission is cancelled. The rates changed on October 29, 2026: until October 28, 2026 inclusive, the commission was 20% during the 3 months following the referral's first payment (25% for a referral attached before October 22, 2026, 9 p.m., Paris time), and these rates still apply to referrals attached during that period; no commission is due for them beyond those 3 months. The 15% for life only applies to referrals attached from October 29, 2026.

Unless specific terms have been agreed with the Publisher, a referral attached from October 22, 2026, 9 p.m. (Paris time) gets 10% off their first 3 months on a monthly subscription, applied automatically at checkout; it does not apply to quarterly or annual subscriptions and cannot be combined with another offer in progress. Your referral also receives 30 credits for the referral, at the latest on their first payment.

Commissions are denominated in euros and build up on your affiliate balance. From €15 of available balance you can request a payout from your Referrals page; the transfer is made through Stripe and requires a completed Stripe Connect account enabled to receive funds. You remain responsible for your own reporting and tax obligations on that income.

Self-referral, including through a second account, fake accounts, spam (unsolicited messages sent in bulk, automated comments), posting your link or code on coupon, voucher or cashback sites, buying ads on the “Carouscale” name (keywords, sponsored results), using accounts or domain names that imitate the brand and any misleading presentation of the Service (promised earnings, claimed affiliation with TikTok) are prohibited. In case of breach, the commissions concerned may be cancelled and access to the program withdrawn. The Publisher may change the commission rate or duration, only for referrals attached after the change, and the payout threshold going forward, without calling into question commissions already earned; specific terms (a higher rate, a dedicated perk for your referrals) may be agreed with certain partners, with no effect on other accounts.

10. Changes to these terms

The Publisher may amend these terms. Users are informed of substantial changes; continued use constitutes acceptance of the updated version.

11. Governing law & disputes

These terms are governed by the law applicable at the Publisher's registered office. In the event of a dispute, an amicable solution will be sought first; consumers may use a consumer mediation service free of charge. Failing agreement, the competent courts will have jurisdiction.
